Note: This discussion mostly applies to individual/family health insurance. Although only a small fraction of the US population has individual market coverage, this is where the bulk of the headlines tend to focus, as it's the market that was most affected by the Affordable Care Act (ACA).

If you get your health coverage from your employer, they will provide details about any changes for the coming plan year, which may or may not follow the calendar year. And if you have government-run health insurance (Medicare or Medicaid), you'll receive communications either from the state or federal government, or from the insurer that manages your coverage (Medicare Advantage, Medigap, Medicare Part D, or a private Medicaid managed care plan).

For millions of people who buy their own health insurance, the American Rescue Plan has increased the size of their premium subsidies and made the subsidies available to enrollees who previously didn't qualify. The larger subsidies are also available to millions of uninsured Americans and people who are enrolled in coverage outside the exchange, but only if they enroll in a plan through their state's health insurance exchange.

January 4, 2022 (Sacramento) -- California consumers and hard-working families will have additional insurance protections under new laws now in effect in 2022. These include laws that provide new health coverage options for older adults being cared for by their adult children, expand requirements for medically necessary basic health care services including women’s reproductive services and increase insurance oversight to protect the safety of people recovering from substance use disorders and prevent child abuse by youth volunteers.

“We are protecting Californians’ health with new coverage options for families caring for older adults while preventing discrimination and abuse,” said Insurance Commissioner Ricardo Lara, who sponsored these new laws. “My Department of Insurance is using every tool at our disposal to protect consumers including expanding and enforcing insurance laws as well as working with the Legislature and Governor Newsom on creating new laws.”

Assembly Bill 570, authored by A-sembly Member Miguel Santiago, will increase access to health coverage and help reduce coverage costs for older adults by allowing adult children to add their dependent parents, or step-parents, to their health coverage policies in the individual market just as dependent children can currently be added to their parents’ health coverage. The Department of Insurance will be implementing the new coverage option, which will be made available during the open enrollment period starting in November 2022, with coverage effective January 1, 2023.

Senate Bill 280, authored by Senator Monique Limón, will remove discriminatory practices in the large group health insurance market by requiring these health insurance policies to cover medically necessary basic health care services such as women’s reproductive services, HIV medicines, cancer treatments, obesity care, and organ transplants. In addition, it codifies the federal Affordable Care Act’s prohibition on discriminatory large group health insurance benefit designs and marketing practices under California law and forbids discrimination based upon s-xual orientation and gender identity.

Assembly Bill 1158, authored by A-sembly Member Cottie Petrie-Norris, will ensure that licensed alcohol or drug abuse recovery and treatment facilities and recovery residences that contract with a government entity maintain minimum insurance coverage levels to ensure more adequate consumer protections.

New home and car insurance rules mean change in prices - BBC News

Anyone renewing their policy will pay no more than they would as a new customer from 1 January.

Brian Brown, consumer finance expert at market analysts Defaqto, said there was no sign of insurers leaving the market as a result, meaning customers still had plenty of choice of products.

The policy is designed to end cases of "price walking", which is when a customer is charged more year after year, by staying with the same insurance company - even though their risk is no greater.

Matthew Upton, director of policy at Citizens Advice, said: "Rip-off renewal prices have seen consumers paying over the odds for far too long. No longer can you be exploited just for staying loyal."

However, premiums charged to all renewing home and private motor insurance customers by their insurance provider cannot be greater than the price they would charge to an equivalent new customer for the equivalent policy.

James Dalton, from the A-sociation of British Insurers, said: "While the FCA recognises that these changes could lead to price rises for some who shop around regularly, all customers should get fairer outcomes in the UK's competitive home and motor insurance markets."

Florida's new insurance law is a boon to the insurance industry

Gov. DeSantis recently signed Senate Bill 2-D into law, and in so doing gave the insurance industry a generous benefit at the expense of Florida property owners.

The law is essentially another layer of reinsurance — it’s a $2 billion fund (plus additional money from the general budget if the governor so desires) that insurance companies can tap into, free of charge.

The law is explicit that no premiums shall be charged to insurance companies for their participation in the program. The law is also clear that insurance companies may draw from the fund without any offsets for reimbursements that they may have received from other reinsurance sources. It provides for 100% reimbursement (90% of losses plus 10% for “loss adjustment expenses") to insurance companies, which is powered by tax dollars.

The law also provides for rulemaking authority, and specifically states that no findings are required for any rules deemed to be enacted on an emergency basis. The rulemaking authority created is specifically exempt from Florida Statute 120.54, which requires single-subject rules, public notice, public rule development workshops and notice of estimated regulatory costs, to name just a few highlights.

Senate Bill 2-D is essentially another layer of reinsurance — it’s a $2-billion fund (plus additional money from the general budget if the governor so desires) that insurance companies can tap into, free of charge.

While the law does provide for a rate reduction to consumers, which is to be commensurate to the cost savings realized by the companies participating in the program, it appears that the insurance companies themselves are free to determine the amount. There is neither a mechanism for oversight nor a penalty for failure to comply.

Americans are in $140 billion worth of medical debt, while the U.S. spends trillions on healthcare each year. With a system bursting at the seams, it’s no surprise that there is increasing support for federal regulation and reform.

Next year, the price transparency rule, the No Surprises Act and healthcare provisions in the Biden Administration’s reconciliation bill will go into effect. Liliana Salazar, employee benefits attorney and chief compliance officer at insurance brokerage Hub International, views these laws as watered-down federal healthcare regulations — but it’s a start.

“What we will see in 2022 is a very diminished version of what these rules were intending to accomplish,” says Salazar. “But we will still have a large number of mandates that will impact the way that the healthcare system operates.”

To start, what can we expect from the price transparency rule?Originally, the transparency rule had multiple price disclosure requirements, including a web-based solution that will allow employees to have an Amazon-like experience where they can compare and contrast the cost of care. This would allow an employee to look for a knee replacement and determine what would be the best cost and the best outcome.

Unfortunately, this provision has been delayed — a large portion of the provisions in the transparency rules have been delayed indefinitely, or have been delayed until July 1st, 2023. Because healthcare providers were concerned about their ability to comply with those mandates on a timely basis while still addressing the pandemic, they reached out to the administration and the regulators to request additional time to comply.

Insurance rates are skyrocketing, insurers are going broke, and Florida insurers are not fully paying claims—some are not doing so because they are going broke and robbing Peter to pay Paul.

One of our law firm’s lobbyists noted that even a Florida Senate leader who is an insurance agent said that the laws being passed would not reduce rates in the short term. I am attaching the House Staff Analysis, the Senate Staff Analysis, and the engrossed bill for those who would like to read the impact of the laws and the actual legislation.

Most of my effort was spent opposing the insurance industry’s attempt to make major changes to Florida’s good faith civil remedy law. The insurance industry wanted to gut laws designed to protect policyholders from the insurers who wrongfully underpay, delay, and deny claims. They were using the most recent “crisis” as an excuse to change those laws which would hold those wrongdoers accountable. “Bad Faith Reform” really means—“let insurance companies not be held accountable when they refuse to fully and promptly pay.”

United Policyholder Executive Director Amy Bach expressed concern about changes in the laws in a phone call I had with her. But she also expressed concerns about marketing practices to policyholders by some contractors, which promote insurance claims which should never be brought. Some of the new legislation addressed those marketing concerns. I have a lot of respect for Amy Bach because she is solely focused on the policyholder’s interest.

Jeff Porter and the Florida Justice A-sociation (FJA) deserve a huge shout-out. The FJA is the major thorn in the side of the Florida insurance lobby and the strongest voice for Florida’s consumers. Without their constant vigilance, many laws harmful to insurance consumers would simply be rubber-stamped because there is no other voice in Tallahassee standing up to the hundreds of insurance company lobbyists. I am proud to be an Eagle Member of the FJA and am amazed at the work Porter and his passionate team do to support policyholder interests.

A New Jersey court has ruled that an insurer is not required to provide coverage to an Uber Eats food delivery driver under the state’s law requiring app-based transport services to provide underinsured motorist for their drivers.

The law requiring transportation network companies to provide at least $1.5 million in underinsured motorists coverage only applies to companies and drivers that transport passengers, the Superior Court of New Jersey in Essex County has ruled.

The case was one of first impression for the court but an easy one for it to decide based on the text of the Network Company Safety and Regulatory Act itself. The law, “by its literal and unambiguous terms,” protects “only those drivers who are in the process of arranging or providing a ride to a rider,” the opinion states.

Scott C. Malzberg was appealing from a lower court’s dismissal of his claim for underinsured motorist coverage against James River Insurance Co. Malzberg was injured in a motor vehicle accident while he was operating his motorcycle in Hackensack as an Uber Eats delivery driver. The Uber Eats app allows food delivery service providers and restaurants to connect with each other so that they can fulfill orders placed by consumers. He also sued Portier, the company that operates the Uber Eats app.

Malzberg signed a contract that warned him that his own insurance may not provide coverage for delivery services and that it was his responsibility to resolve issues with his own insurer.

Assembly Bill 506. Will require youth service organizations to implement child abuse and neglect prevention measures, mandate administrators, employees, and regular volunteers of youth service organizations to take training on child abuse and neglect identification and reporting, and permit liability insurance companies to confirm compliance with these requirements.

Senate Bill 334. Will require private, for-profit prisons and detention facilities operating in California to adhere to all state and local health, safety, fire, and labor standards already mandated for state and local publicly managed prisons and facilities while also requiring they obtain workers’ compensation and liability insurance coverage from an admitted insurance carrier authorized by the CDI to do business in California.
