In accordance with Sections 4-107, 4-201 and 8-407 of the Insurance Article, Annotated Code of Maryland, each insurer authorized to write insurance in the State of Maryland, as a condition of doing business in Maryland, must appoint the Insurance Commissioner as attorney for service of process issued against an insurer in Maryland.

The Maryland Insurance Administration will accept service for companies authorized to operate in the State of Maryland and certain other insurance companies who are not currently authorized to operate in Maryland. However, service for companies who do not write insurance should be served directly to the company. You MUST provide the full legal name of the insurance company; otherwise, your documents will be returned. A listing of authorized insurance Companies can be found here: information about companies.

If you have paid the processing fee through the court system, you MUST supply proof of payment to the Maryland Insurance Administration at the time you submit the documents. Otherwise, your documents will be returned.

The Maryland General A-sembly’s Office of Legislative Audits operates a toll-free fraud hotline to receive allegations of fraud and/or abuse of State government resources. Information reported to the hotline in the past has helped to eliminate certain fraudulent activities and protect State resources.

Physicians and health providers: please find below information about how to file a complaint, credentialing for fully insured health plans, and prompt payment of claims. If you have questions please contact our Life and Health Complaint Unit at 410.468-2244.

Maryland’s Prompt Pay law is stated in § 15-1005 of the Insurance Article. It applies to health policies issued in Maryland by insurers, nonprofit health services plans, health maintenance organizations, Medicaid managed care organizations, and the Medicaid mental health administrative serviced organization (carriers). It does not apply to Medicare, including Medicare Advantage plans, or the Federal Employee Health Benefit Program. It also does not apply to self-funded benefit plans offered b employers, where the insurer provides only administrative services. Property and casualty claims, including PIP and Worker’s Compensation claims, are not subject to the law.

This law requires payment within 30 days of receipt of a “clean” claim. Clean claims, and the information a carrier may request, are defined in COMAR 31.10.11. If a claim is not clean or is in dispute, notice stating the specific information required to process the claim must be sent within 30 days. Interest is required to be paid along with late claim payments. For a detailed understanding of the law, you should read the statute and regulations.

If you have multiple complaints about the same carrier, please provide a representative sample of no more than ten claims. Include the date of service, date of submission, how it was submitted (electronic or paper), and a copy of the claim form and member identification card, if available. If additional information was requested by the carrier, include the claim number, and the date of re-submission.

Section 15-1008 of the Insurance Article limits when a carrier may retroactively deny reimbursement of a health claim that has already been paid to the provider. In general, a carrier is limited to six months from the date a claim is paid to retroactively deny the claim.

Maryland Insurance Administration - Origin & Functions

In 1872, the Maryland Insurance Administration began when the General A-sembly authorized the Insurance Department under the Comptroller of the Treasury (Chapter 388, Acts of 1872). Renamed the State Insurance Department, it became an independent agency in 1878 (Chapter 106, Acts of 1878). As the Insurance Division, it moved to the Department of Licensing and Regulation in 1970 (Chapter 402, Acts of 1970). It was reorganized as the Maryland Insurance Administration, an independent agency, in 1993 (Chapter 538, Acts of 1993).

The Administration licenses and regulates insurers, insurance agents, and brokers who conduct business in the State, and monitors the financial solvency of licensed insurers. The Administration also is responsible for collecting taxes levied on all premiums collected by insurance companies within Maryland.

Periodically, the Maryland Insurance Administration examines all companies organized under the laws of Maryland, and scrutinizes nonresident companies doing business in the State. The Administration also investigates consumer complaints and questions concerning insurance companies operating in Maryland, and resolves insurance appeals and grievances about coverage decisions or claims denials.

The Administration is a specially funded State agency supported entirely through fees and a-sessments on the insurance industry. In lieu of a State income tax on insurance company profits, the Administration collects a 2 percent tax on premiums. Up to 60 percent of the Administration's annual appropriation is funded by a-sessments on the insurance industry. The remainder comes from fees.

Two separate funds support activities of the Administration: the Insurance Regulation Fund, and the Health Care Regulatory Fund. The Insurance Regulation Fund supports the administrative and regulatory activities of the Administration (Code Insurance Article, sec. 2-505). The Health Care Regulatory Fund funds the costs of compalint investigations about payment denials involving medical necessity (Code Insurance Article, sec. 2-112.3).

I had a complaint - specifically about USAA refusing to cancel my dead father's insurance. i sent death certificates and letters of administration four times and USAA ignored me. so I contacted md insurance admin. Mr. Love is on the insurance companies side and, even though he has not been in the office, agrees with USAA that the seal is not 'raised' enough on the letters of administration. I had to write the register of wills. of course, they can't do anything but report that USAA is not accepting their legal documents."
