§1892. Payment and adjustment of claims, policies other than life and health and accident; vehicle damage claims; extension of time to respond to claims during emergency or disaster; penalties; arson-related claims suspension

A.(1) All insurers issuing any type of contract, other than those specified in R.S. 22:1811, 1821, and Chapter 10 of Title 23 of the Louisiana Revised Statutes of 1950, shall pay the amount of any claim due any insured within thirty days after receipt of satisfactory proofs of loss from the insured or any party in interest. The insurer shall notify the insurance producer of record of all such payments for property damage claims made in accordance with this Paragraph.

(2) All insurers issuing any type of contract, other than those specified in R.S. 22:1811, R.S. 22:1821, and Chapter 10 of Title 23 of the Louisiana Revised Statutes of 1950, shall pay the amount of any third party property damage claim and of any reasonable medical expenses claim due any bona fide third party claimant within thirty days after written agreement of settlement of the claim from any third party claimant.

(3) Except in the case of catastrophic loss, the insurer shall initiate loss adjustment of a property damage claim and of a claim for reasonable medical expenses within fourteen days after notification of loss by the claimant. In the case of catastrophic loss, the insurer shall initiate loss adjustment of a property damage claim within thirty days after notification of loss by the claimant except that the commissioner may promulgate a rule for extending the time period for initiating a loss adjustment for damages arising from a presidentially declared emergency or disaster or a gubernatorially declared emergency or disaster up to an additional thirty days. Thereafter, only one additional extension of the period of time for initiating a loss adjustment may be allowed and must be approved by the Senate Committee on Insurance and the House Committee on Insurance, voting separately. Failure to comply with the provisions of this Paragraph shall subject the insurer to the penalties provided in R.S. 22:1973.

(4) All insurers shall make a written offer to settle any property damage claim, including a third-party claim, within thirty days after receipt of satisfactory proofs of loss of that claim.

Louisiana Health Insurance Laws, Plans and Regulations | EINSURANCE

Louisiana health insurance offers protection for you and your family members. Check Louisiana health insurance plans, laws, regulations and requirements.

As a Louisiana resident you can choose from health insurance plans offered to individuals and groups by private insurance companies. You may also purchase individual and family coverage from participating private insurers through HealthCare.gov, the federal exchange. If you are self-employed with no employees, you can also use the federal exchange to purchase coverage. You may also be entitled to certain state and federal programs such as Medicaid and COBRA.

The Patient Protection and Affordable Care Act (also known as ObamaCare and the Affordable Care Act and referred to in this guide as ACA) became law in 2010. Provisions of the law have continued to be phased in following passage. As of January 1, 2014, most U.S. citizens and legal residents are required by law to have qualifying health care coverage or pay an annual tax penalty for every month they go without insurance. This is called the “individual mandate.” There is a grace period through March 31, 2014. Beginning in 2014, the penalty for not having qualifying coverage is $95 per adult and $47.50 per child or 1% of your taxable income; whichever is higher (up to $285 per family). The penalty increases annually through 2017 and beyond.

If you own a small business in Louisiana (50 or fewer full-time-equivalent employees – FTEs), you can purchase qualifying coverage for your employees through SHOP, the Small Business Health Option Program or through a private broker or insurance agent. However, you may qualify for tax credits worth up to 50% of your premium costs if you use SHOP. Beginning in 2016, SHOP will be open to employers with up to 100 FTEs. Under the Employer Shared Responsibility provision of ACA, beginning in 2015, all employers with 50 or more FTEs must offer employees at least one plan that is ACA-compliant or face fines of $2,000 per employee.

To help you more easily compare costs and benefits, ACA designates that all qualifying plans be one of four metals: Bronze, Silver, Gold and Platinum. Each is based on the average amount of healthcare costs the plan will cover shown as a percentage of what is covered by your insurance company and what is paid for by you. All insurers participating in the federal or a state healthcare exchange must offer , at minimum, Silver and Gold plans. All metal plans have a shared maximum out-of-pocket amount that you can be charged in any calendar year.

Under ACA, no one can be denied coverage or charged significantly higher premiums because of past health history (pre-existing conditions) or gender. There can be no look-back or waiting periods imposed. Policies are effective on issue. All coverage is renewable, if you choose to renew it. Plans can only be canceled for non-payment of premiums or fraud. The guaranteed issue provision applies to all non-grandfathered plans.

Louisiana Insurance

Majority of the vehicles in Louisiana are covered with auto insurance. In Louisiana, it is a requirement for all types of cars to be covered with insurance. Examples of vehicles that don’t need insurance coverage include parade vehicles and vehicles owned by the government in Louisiana. The liability insurance limit in Louisiana is 15/30/25. It means that you have to buy bodily injury coverage worth $15,000 for person. The insurance coverage limit for per accident is $30,000. For property damage, the liability insurance coverage limit is $25,000.

Uninsured/underinsured insurance is an optional coverage In Louisiana. The uninsured/underinsured insurance provides protection for motorists that are hit by drivers without insurance or insufficient coverage. It provides protection for any accident victim that suffers from bodily injury. Although it is not a requirement in Louisiana, it is recommended that you purchase it. To protect you from bankruptcy, you should purchase sufficient insurance to cover all the damage costs that are likely to incur in the accident.

If you are using a rental car, you have to buy the rental car insurance. The requirement for the rental car insurance is different than the requirement for the liability insurance. You can obtain the rental car insurance for free if you have a credit card. You have to purchase the rental car insurance if your credit card company does not offer it for free of charge.

Every driver must provide proof of financial responsibility. You are required to show the insurance card when the law enforcement officer request it. It is important that you carry the insurance card no m matter where you go. If you did not carry the insurance card, you will be fined. The amount of fines incurred the driver depends on how long you take to produce the document proof. If you manage to provide the insurance coverage proof within 10 days, you won’t be fined. If you produce the proof between 11 – 30 days, you will be charged with a fine of $50. If you tarry up to 90 days, you will have to pay a $125 fine. If you take more than 91 days to show the insurance proof, you will be fined up to $225.

The costliest hurricane to hit the U.S. was Hurricane Katrina, which touched ground in 2005. It caused over $38 billion in insured losses for the state of Louisiana. Not to mention 1,800 fatalities as well. Louisiana’s tendency to be impacted by these severe storms is nestled in the fact that its largest city, New Orleans, is along the Mississippi River and quite close to the Gulf of Mexico. Thus, property owners not only have to worry about the common perils your standard homeowners or renters insurance policy cover, such as fire, vandalism, and theft; they also have to protect their property from flood and other hurricane related losses.

The Pelican State’s track record regarding natural disasters and catastrophic loss limits the amount of competition that exists in the property insurance market. Essentially driving rates higher, making it harder for property owners to source adequate coverage.

Section XIII-10109 - Filing and Review of Life and Annuity Insurance Policy Forms and Related MattersA. Definitions. As used in this Section, the following terms shall have the meaning or definition as indicated herein.

Basic Insurance Policy Form-an insurance contractual agreement delineating the terms, provisions and conditions of a particular insurance or annuity product. It includes certificates of coverage, application forms where written application is required and is to be attached to the policy or be a part of the contract, and any life or health and accident rider or endorsement form. It does not include policies, riders, or endorsements designed, at the request of the individual policyholder, contract holder, or certificate holder, to delineate insurance coverage upon a particular subject or which relate to the manner of distribution of benefits or to the reservation of rights and benefits under such policy.

Certification of Compliance-certification by an insurer, executed by an officer or authorized representative of the insurer on a form prescribed by the department, that upon knowledge and belief a filing is complete and in compliance with all applicable statutes, and rules and regulations promulgated by the department. A certification of compliance must be included with any filing for certified approval.

Certified Approval-approval on the basis of an expedited review by the department of a complete filing based upon the inclusion of a statement of compliance and a certification of compliance, executed by an officer or authorized representative of the filing insurer on forms prescribed by the department. The department shall by directive determine those specific types of coverage and particular types of contracts for which the certified approval procedure is either required or available at the option of the insurer

Complete Filing-the filing of a single insurance product, including any required filing fees; a basic insurance policy form, application form and supplemental application form, if any, to be attached to the policy or be a part of the contract; any life or health and accident rider or endorsement forms; all items required under Subsection C hereof, "General Filing Requirements," and any other requirements as may be set forth in the applicable statement of compliance.

The Louisiana Department of Insurance has approved Louisiana Citizens’ request for a 63% rate increase on its residential property insurance policies beginning Jan. 1, 2023.

The Louisiana Department of Insurance has approved Louisiana Citizens’ request for a 63% rate increase on its residential property insurance policies beginning Jan. 1.The rate increase will not affect Citizens’ current policyholders until they renew their policy after that date.Louisiana law requires the Citizens’ rate for each of its policy types in each parish to be at least 10% over the highest qualifying market rate or 10% over the actuarial rate, whichever is higher.Citizens policyholders should be aware of the following:The rate increase will not affect your policy until renewal. For example, if you get a Citizens policy on Nov. 1, 2022, your premium will be unaffected through Oct. 31, 2023.Citizens policyholders should contact multiple independent insurance agents at least monthly to request quotes from private insurers.The LDI expects the number of insurers writing policies to increase in the coming months. Citizens will refund your unearned premium if you find a policy with another insurer before the end of your Citizens policy term.

Louisiana law requires the Citizens’ rate for each of its policy types in each parish to be at least 10% over the highest qualifying market rate or 10% over the actuarial rate, whichever is higher.
