The deadline to link your Permanent Account Number (PAN) and Aadhaar is March 31, 2023. Do note that now there is a penalty applicable for linking PAN with Aadhaar. If you do not link your PAN and Aadhaar before the March 31, 2023 deadline, then your PAN will become inoperative. According to a recent Income Tax Department tweet: “As per Income-tax Act, 1961, it is mandatory for all PAN holders, who do not come under the exempt category, to link their PAN with Aadhaar before 31.3.2023. From 1.04.2023, the unlinked PAN shall become inoperative. Please don’t delay, link it today!”

According to a Central Board of Direct Taxes (CBDT) circular dated March 30, 2022, “Rule 114AAA of the Income-tax Rules provides that if PAN of a person has become inoperative, he will not be able to furnish, intimate or quote his PAN and shall be liable to all the consequences under the Act for such failure.”
As per an advisory issued by the income tax department in the Times of India edition of March 6, 2023, following are 6 consequences of not linking your PAN with Aadhaar.
Your PAN will become inoperative.Filing ITR will not be possible.Pending returns will not be processedPending refunds cannot be issued.Pending proceedings, as in the case of defective returns cannot be completed.Tax will be deducted at a higher rate.If you have not linked your PAN with Aadhaar, here is how you can do it as per the Income Tax Department website.
How to link PAN with Aadhaar
Step 1: Visit Income tax website. (https://www.incometax.gov.in/iec/foportal/)
Step 2: Under quick link section, click on ‘Link Aadhar’ option.
Step 3: Enter Aadhaar number and PAN, and pay late fee of Rs 1000 through ePay tax functionality after following on screen instructions.
Step 4: Once, payment is complete, visit ‘ Link Aadhaar’ section again and enter your name, mobile number, Aadhaar number and PAN.
Step 5: Verify the information by selecting ‘ I agree to validate my Aadhaar details’ option and click on ‘Link Aadhaar’ option.
Step 6: Enter the OTP received on your mobile number and click on ‘ Validate’ to complete the linking process.

Step 1: Go to the income tax e-filing website: www.incometax.gov.in
Step 2: You will find the 'Link Aadhaar Status' option under Quick Links
Step 3: Enter your PAN and Aadhaar number and click on the 'View Link Aadhaar Status' option.
Step 4: If your PAN is linked with your Aadhaar, a message will display on your screen.

Who needs to link Aadhaar and PAN?
According to the Income tax website, “Section 139AA of the Income Tax Act provides that every individual who has been allotted a permanent account number (PAN) as on the 1st day of July, 2017, and who is eligible to obtain an Aadhaar number, shall intimate his Aadhaar number in the prescribed form and manner. In other words, such persons have to mandatorily link their Aadhaar and PAN before the prescribed date (Presently, 31.03.2022 without fee payment and 31.03.2023 with prescribed fee payment). For more details refer to CBDT circular No.7/2022 dated 30.03.2022.”
For whom is Aadhaar-PAN linkage not compulsory?
Aadhaar-PAN linkage requirement does not apply to any individual who is:
I) Residing in the States of Assam, Jammu and Kashmir, and Meghalaya;
II) A non-resident as per the Income-tax Act, 1961, if the age of eighty years or more at any time during the previous year;
III) Not a citizen of India,as per the Income Tax website.
